Why the H-1B1 changes the maths for an employer

The H-1B1 comes from the Chile–US Free Trade Agreement, signed in 2003 and in force since 2004, and carries a reserved annual allocation that has never been fully exhausted. For an employer the operational difference is concrete: there is no prior USCIS petition and no lottery, so the case is processed consularly and the calendar stops depending on the US fiscal year.
