No. Unlike the H-1B, the H-2A has no numerical ceiling and no random selection. The real constraint is operational: the employer must first obtain a temporary labour certification from the Department of Labor, and that filing has deadlines counted backwards from the start of the season.

No degree is required. That is the substantive difference from the H-1B, H-1B1 and O-1, which all turn on credentials or track record. What is established here is the employer's temporary need and the agricultural nature of the work, not the worker's academic profile.

The employer must offer the job to US workers first, pay the regulated wage rate the Department of Labor sets for the area and crop, provide housing at no cost, cover inbound and outbound transport, and guarantee a minimum number of hours over the contracted period.

After three years the worker must leave the United States for an uninterrupted period before applying again, so the category does not work as a route to continuous residence.

The H-2A is limited to nationals of countries the Department of Homeland Security designates on a list published and renewed each year. Chile has appeared on that list, but because the designation is annual it is worth confirming it in the most recent notice before starting anything. That is an important difference from the H-1B1, whose Chilean access sits in a treaty rather than on a renewable list.

Yes, a spouse and unmarried children under 21 can apply for H-4 visas. The H-4 allows study and residence, but does not authorise work for the dependants of an H-2A holder. If a spouse needs to work, they need a status of their own that permits it.

It is not a dual-intent category: applying for it requires showing the intention to return home when the job ends. Starting a residence process while in H-2A status can complicate an extension or a new entry. If the goal is to stay, the right conversation is about the EB categories, not this one.
