O-1 visa: frequently asked questions

It is the visa for those who demonstrate extraordinary ability and sustained national or international acclaim. O-1A covers sciences, education, business and athletics; O-1B covers the arts and the motion picture and television industry. It requires a US employer or agent to file the petition.

No. The O-1 is established through demonstrable achievement, not academic credentials. It is one of the few categories where a professional without a formal degree but with a distinguished record can qualify — impossible under the H-1B or H-1B1, which require a degree or its equivalent.

You must meet at least three of eight: recognised awards, membership in associations requiring outstanding achievement, coverage in professional media, having judged the work of peers, original contributions of major significance, authorship of scholarly articles, employment at distinguished organisations, and high remuneration relative to the field.

It is a letter from a union, guild or peer group in the field confirming that the profile matches the category sought. It is a formal requirement of the petition. Where no competent organisation exists in the field, USCIS accepts documented alternatives.

It is granted initially for the time needed for the event or project, up to three years. It can then be extended in one-year increments with no overall cap. That is its main advantage over the H-1B, which runs out at six years.

Not automatically, but it is a natural precursor to the EB-1A, the extraordinary ability residence category, which requires no job offer and no PERM certification. Evidence assembled for the O-1 usually forms the basis, though the EB-1A standard is more demanding.

Yes, through the O-3 visa for a spouse and unmarried children under 21. O-3 permits study but does not authorise work. A spouse who needs employment must obtain a status of their own that allows it.

Yes, but it requires structure. Each employer must be covered by a petition, or a US agent can file the petition and document the itinerary of engagements. That is the usual route for independent profiles in the arts and technology.
